News regarding our legal troubles with nutter conspiracy theorists

The Pompeii Obsession

The Pompeii Obsession

Hey ZGeek, hoping for a shameless plug for my new site as I kinda need content and followers… including dicks drawn in dusty car windows… but here is a recent article from the site.

In a previous post, we mentioned that the ancients were utterly and totally obsessed with the penis, and while there are a tonne of ancient cave drawings depicting gigantic cocks, it doesn’t stop there.

One of the most famous sites around the world to contain artwork of such things is the ancient city of Pompeii, which was completely obliterated in 79AD when Mt Vesuvius erupted, like a geological version of a finale in any given porno, and covered the city in hot white… ash.

40+ members of ZGeek now involved in our defamation suit

40+ members of ZGeek now involved in our defamation suit

I do apologise for the late update but I’m been a bit busy with work and personal matters. A few weeks ago was a huge week in our legal battle.

Unfortunately the courts have compelled disclosure of certain details of some ZGeek members to the person who has been keeping us in Court for the last three years. So I have had to hand over the contact details for over forty ZGeek members who now could be listed as possible defendants in the defamation action. Some of these people did not even post in the threads, or simply commented on threads in which the plaintiff was not identified.

The Court compelled the disclosure of these details to the plaintiff despite our objections that this person is linked to the Jonathan Nolan and Greg Smith who have been the subject of allegations of fraud in the media and that these details may be used improperly. Smith and Nolan attempted to sue us for $42.5 million dollars after they alleged they had lost a movie deal after ZGeek members bagged the book on which they said they were basing their movie.  The book set out a ridiculous conspiracy theory that nuclear bombs where used in the 9/11 attacks.

Anyhow the battle continues and the need for funds is now greater than ever before.

iPhone fingerprint scanner – Its a Trap!

The privilege against self incrimination extends only to the accused in respect of testimonial evidence.  Physical evidence is up for grabs.  Also hacking an iPhone has proven to be not all that hard for some so beware unauthorised access or bluetooth raids cause it might be your local law enforcement agency conducting their investigations in a new and creative manner.

OBJECTION!!! OVERRULED!!!

OBJECTION!!! OVERRULED!!!

Hello again. It’s super fun legal happy time YAAAAAAAAYYYYYYY.

We need some help on the legal front. Not donations (but that would also really help). But for a legal-type-solicitor-lawyer person located in the ACT or NSW who can do pro-bono or costs work for us.

Because after four years of this crap, we’re running on fumes. We still have our mates at Reardon and Associates in QLD helping us out and doing all the work, but we need someone on the ground in the ACT or NSW. We can’t afford to hire a lawyer at the moment until some of the previous legal action is finished.

ZGeek is currently fighting its fourth defamation battle over comments posted in our forums. The first finished with a lol, the next two were thrown out when the person decided not to come to court. But they decided they are really are cranky at us so we need to be sued again. So here we are.

If you are in the legal trade, or you know someone who is and you can ask them. Please do so! Drop me a line here. We are building a fighting force of extraordinary magnitude. We forge our tradition in the spirit of our ancestors. You have our gratitude!

ps. To the person suing, before you print this out and add it to your complaint. That was a movie reference. It was said by Dr Klahn in the 1977 movie “The Kentucky Fried Movie“. As is the title of this post, as was the subject matter of your original complaint.

Cya all for a while…

Cya all for a while…

I’ve decided to take a break from ZGeek while I fight the insanity around the current legal harassment. It seems everything I post is an affront to the thin skinned so for the sake of the site and members, I am going to step away until it is resolved and only pop by to give you updates.

I have handed over the day-to-day of the site to the usual care takers. In the meantime, please keep donating if you can and keep sending in news and links. We are now fighting two court actions in this ridiculous and pointless saga so any help we can get would be very much appreciated.

I will be back. Take care all!

ZGeek being sued for defamation for the the fourth time

ZGeek being sued for defamation for the the fourth time

It is my unfortunate job once again to announce that ZGeek is being sued for defamation. Again by the same person who attempted to sue us twice earlier this year along with Google for defamation.

It’s not a new filing, but an attempt to get the courts to relist the same defamation action that the person abandoned. This time, without naming Google. I see it as nothing more than an attempt to intimidate me into backing down from appeal regarding costs that were awarded to us for another matter.

I will not give up. I cannot give up. Unfortunately this means more legal fees and after three years of defence, the legal fund is done. So, I once again turn to you and ask for your support.

For the last three years we have been targeted for legal action. In these three years ZGeek and I have not been found guilty of anything. Yet this person just keeps filing action after action. In my opinion this is nothing but manipulation of our court system to  create as much hardship on me as possible. So I need your help. I can’t do this on my own, cost financially and emotionally has devastated me.

We still have the awesome Reardon & Associates and their friends helping us out. But legal costs are mounting and I can’t afford it myself. So if you can spare a few dollars, please donate here via paypal.

I really feel bad about asking this yet again.

Comments are open, but please don’t make negative comments about this person as they will just us it as an example on how I ‘encourage” you guys to be bad people. So please don’t.

ZGeek – Google Defamation case dismissed, but legal woes continue

ZGeek – Google Defamation case dismissed, but legal woes continue

It’s been a while since updates, but we hit a milestone with our legal troubles. The defamation case that was filed against us and Google has been dismissed. The person who started the proceedings against us in NSW and in the ACT just didn’t bother to turn up to court for both cases and they were dismissed.

Yay! But no.

Unfortunately this has not ended. We now have to fight an appeal for the costs we won.  Worse still is the awesome, wonderful, kick-ass lawyers at Reardon and Associates have had to move on to other cases as they need to pay the bills. They are still supporting us 100% but can’t send a lawyer to the ACT anymore as they don’t have the man power. We still have our Barrister from Reardons on board but we are seeking a solicitor to appear for us in the ACT.

Once this is appeal is done, then I hope we can put this foolishness behind us and get on with the usual foolishness that we actually enjoy.

So if you know of any lawyers/solicitors who can help us out. Please let us know, or if you can spare a dime, then drop us a donation for the legal fund. We are near the end, but it looks like we still got a bit of a challenge ahead.

Update on ZGeek’s defamation fight

Update on ZGeek’s defamation fight

Hi all, Just an update on our legal woes. Good news for a change!

As you know we are being sued along with Google for defamation. The person suing us launched proceedings in both the ACT and NSW.

We had a court appearance last Friday for the ACT proceedings but the person suing us just didn’t turn up to court so that matter has been struck out.

How bloody awesome is that! We still have the defamation in NSW to deal with this month. We are super confident of defending ourselves against this and I’ll post updates as soon as I can.

In the meantime, if you can donate to the legal fund. Please do so!

ZGeek and Google named in defamation case

ZGeek and Google named in defamation case

Hi all,

It is well documented that ZGeek has been harassed with legal action since 2010. Unfortunately, we are once again being sued. This time around; ZGeek is named in a defamation suit along with the co-defendant, Google. We are being sued for user comments on the site and Google is being sued for listing these in their search results.

Our message is, we are seeking any NSW based lawyer who can help us to fight these erroneous claims. The person suing us seems keen to go ahead, they have even planned to move interstate to sue me (now that’s commitment!).

This case is very important; if we are found liable, all webmasters in Australia will be liable for their user comments. Basically this is Australia’s version of SOPA. If they win, no webmaster is going to allow free comments on Australian based sites as they could be sued.

So it’s important for us to find a lawyer ASAP. Or the only person going to be defending your freedom of speech online is me. I’m a person that is excellent at technology and computers, but my law skills are a little lacking.

If you or anyone knows a lawyer around Sydney who is willing to take on the case, please contact them on behalf of ZGeek. Ask the prospective lawyer to contact me via this address – legal@zgeek.com.

Further more, donations can once again be made to the ZGeek paypal account (on the right of this page) or by direct transfer. In addition to donations, you can simply purchase a subscription. All money goes to the legal fund and any left over money is funnelled back into the running costs of the site. I want to make this perfectly clear – I am not profiting from this in any way. ZGeek is a non-profit organisation set up for its members.

Gizmodo’s take – Ok it’s not Australia’s SOPA (told you I was not good with this legal stuff) :D

IMFI Pty Limited

Jonathan Nolan the man behind the alleged TV show “Starwalker“, has emerged from hiding to launch a new venture. According to the Starwalker: It’s all a bad fraud website, the new business claims to be setting up solar power facilities in Vanuatu.

This was posted by a Robert Brand.

His latest “business” venture is solar powered ATMs in Vanuatu and solar farms. Pay him a flat fee of $165,000 and he will help you. Quite the entrepreneur. I have actually built solar powered systems. I wonder what his credentials are? He is in the middle of a court case at the moment for not paying actors on past productions and he missed this weeks appearance with rather a flimsy excuse. The group that was claiming was asked what they would like to do and they happy granted him the extra week to make good with the money. He must be pretty hard pressed at the moment to come up with another excuse for next week. This is actually from my viewpoint the start of the legal end for the guy. His wife and he are involved with the company he formed called IMFI Pty Limited. I had thought that she was not involved in his scams, but I have had to rethink this in recent times. I believe that she is really supporting this guy and protecting him.

Mr Brand is still persuing Mr Nolan for alleged unpaid wages in relation to the work he did for the now defunct Starwalker Reality TV show. Mr Nolan was involved in the attempt to sue us for $42.5 million for alleged defamation after users of ZGeek made fun of this conspiracy booklet claiming that nuclear bombs were used in the 9/11 and Bali bombing attacks.

Merchant of Death gets sent to the US

Merchant of Death gets sent to the US

One of the worlds most “prolific arms dealers” who reportedly inspired the Hollywood film “Lord of War” will be escorted by 50 Thai commandos when he is extradited to the US.

The alleged Russian arms dealer, Viktor Bout, who is dubbed the “Merchant of Death” and faces terrorism charges, went from jail to a Bangkok airport today for his extradition to the United States, Thai police said, despite opposition from Moscow.

US authorities have sent a private jet to Don Mueang airport to fly out Bout, said Crime Suppression Division acting chief Supisarn Bhakdinarinath.

Yeah I heard there was a movie being made about this guy. I wonder what happened to it. :mdr:

Greg Smith Jonathan Nolan of Myrmidon Enterprises vs. ZGeek

Greg Smith Jonathan Nolan of Myrmidon Enterprises vs. ZGeek

This matter has been settled but feel free to have a read through this as some of it is pretty funny. Basically, two conspiracy theorists started a thread about their conspiracy book called “A Third Truth” and got flamed. Then attempted to sue us for $42.5 million.

Not only where they defeated when Greg Smith couldn’t provide any proof that the film was real, yet alone in production. But their reality TV show “Starwalker” was exposed as an alleged scam.

These guys chose the wrong site to mess with as we where able to defend ourselves and also expose these guys and their dodgy methods. :)

Click the read more for the whole story.

Please note! The Jonathan Nolan mentioned in this is NOT the creative genius Jonathan Nolan behind Memento, The Dark Knight and Inception. Although both share the same name these two people are entirely unrelated and the talented Jonathan Nolan has had nothing at all to do with these shenanigans.

Starwalker producer Jonathan Nolan exposed on TV

April 27, 2010: A new reality TV show promised to turn two winners into astronauts and send them into space, but it appears the competition was never going to get off the ground, despite charging $10 per entry.

This are the same guys who tried to sue us for $42.5 million.

The whole television show Starwalker has been shown to be nothing but lies on top of more lies.

Waste of space: how astronaut reality show hit a black hole

http://www.youtube.com/watch?v=oEUpy26gVTw

Jonathan Nolan had plans for the world’s most ambitious reality show – a global cross-continent space challenge pitting prospective astronauts against each other for the chance to win two tickets into space.

He told media, partners and contestants that he had already secured two seats on Russian Soyuz rockets, had a production partner in Britain and had already obtained from foreign investors the tens of millions of dollars required to get the project off the ground.

Like this was ever going to happen…

Starwalker to be investigated by current affairs show

Starwalker to be investigated by current affairs show

An update on the erstwhile Starwalker “reality series”, for anyone who’s interested in that cosmic soap opera with more twists than Battlestar Galactica….

It seems that with the leaves turning Down Under, the Australian media have awoken from their summer slumber and are beginning to look into the show’s executive producer/bad filmmaker/disbarred attorney/crackpot UFOlogist Jonathan Nolan. (How would you like that on your business card?)

Posting on the Starwalker: It’s All a Bad Fraud Facebook page, Robert Brand says that he will be filming a piece for Australian television about his experiences with Nolan. Brand says that he moved his family to take a job with the show only to be let go without being paid. He ran into serious financial difficulties, including nearly having his car repossessed, but has since found a paying job.

For those unfamiliar with this taudry story, here’s the first part of a long recap.
FYI, Mr Nolan is the guy who started the shennanigans that lead to his chum filing a $42.5 million defemation suit against us. So, to say I am happy about this is an understatment. I hate these current affairs shows, but this time they are doing some good. As soon as we find out when and where this is going to happen, I will let you know. In the meantime, view the source for the whole story.

Starwalker assplodes

Starwalker assplodes

It seems the production of Starwalker, the reality show being made by the chaps who attempted to sue us for $42.5 million has gone completely tits up.

The production team has gone completely silent leaving contestants and now it seems, employees in the lurch. One employee Robert Brand who left the show has not been paid for his work and is now dishing the dirt on the show’s executive producer Jonathan Nolan and preparing to sue him for his wages.

One thing that really stood out to me is a comment about the guy who was organizing the spaceflights.

The person confirming the 2 bookings was “Dmitri K. Kumetzov”. At this time everyone at Starsem that I talked with knew of no such person working for them in France.

This is really odd. You see the mysterious backer who allegedly pulled out of their film because of the comments on ZGeek was named “Dimitri A. Khalezov”… odd huh? Oddly too, when we contacted the film company he was supposedly from, no one had ever heard of him as well.

Anyway, head over to the facebook group for all the goss and the lols. Continue reading

The defamation suit is done, but it’s not over

The defamation suit is done, but it’s not over

Ladies and Gentlemen, our defamation lawsuit maybe over but our legal troubles are not. Unfortunately we’ve got a new problem related to that lot and unfortunately I am not allowed to tell you anything about it. Not a word as I am under orders of the LAW.

But what I can tell you is this, I am looking for a barrister or lawyer based in Canberra wouldn’t mind coming with me to court next month. They wouldn’t need to do any work. The awesome chaps from Reardon’s have done all that and their role would be of someone to help me through the process or take charge and kick arse on my behalf. Whatever they choose.

So if you know anyone, please ask them. We can offer pimping, a small fee and the love of a thousands of geeks.

Tony Brisciani beats Myrmidon Enterprises $42.5 million defamation lawsuit

Tony Brisciani beats Myrmidon Enterprises $42.5 million defamation lawsuit

The $42.5 million lawsuit against ZGeek has ended after our lawyers required the plaintiff to provide proof of the movie deal that was purportedly lost due to comments posted on this site. We have chosen not to pursue the issue of costs as against the plaintiff as we have formed the view that the collection of any costs which may have been properly awarded against him would likely be uneconomical to pursue.

The lawsuit started back in July 2009 after the plaintiff’s business partner Jonathan Nolan posted advertisements in our forum encouraging people to buy his conspiracy book “The Third Truth”. A book which claims to have proof that the 9/11 and Bali attacks were nuclear; a theory which the plaintiff supported.

Since the plaintiff started the defamation suit he also applied for a trademark of ZGeek’s name and threatened us with a further lawsuit for using “his” trademark despite it not being approved by the Australian Trademarks Office. He has agreed in writing not to pursue that application as part of the settlement agreement.

ZGeek would like to thank Dev Menon and all the staff of Clamenz Corporate Lawyers for their time and skill in helping us defend this matter. Dev and his associates at Clamenz have gone above and beyond in helping ZGeek. They have worked for costs and continue to provide us with advice in protecting the future of ZGeek from further legal harassment.

We’d also like to thank Reardon & Associates for their advice and hard work helping us through this and their continuing support. Also a massive shout out to the EFA for helping us with offering legal help on the trademark issue. I’m happy to say that I am now a member of the EFA (supporting only) and will happily use the small influence ZGeek has to help them out in return.

We’d also like to thank our community for all the help and support you provided to Buffy and I through this. You’re an amazing group of people and make this site worth doing. So and from the bottom of our pits, we thank you. We couldn’t have got through this without you.

For more information on this case and the porkies we caught them out on (while they where suing us, lol). Click here.

Myrmidon Enterprises’ Starwalker show continues to implode

Myrmidon Enterprises’ Starwalker show continues to implode

Despite claims by Myrmidon Enterprises that Starwalker is going ahead. Two more of their crew have abandoned the show stating

We are no longer part of the show. We did not know certain things about the Executive Producer (Jonathan Nolan) until now. So we do not want any parts of the show!

and

Mischa and I on behalf of Viper Productions, LLC is no longer part of the Starwalker project. Due to organizational structural changes, we are no longer associated with the show. We wish the best to all of you!

The two, Richard Myles and Misha Perez are best known for their Indy horror movie Mental Scars and were the only members of the show with any actual successful film making experience.

The announcement has created talk of legal action against Myrmidon Enterprises’ management Greg Smith and Jonathan Nolan (the same guys who attempted to sue us for $42.5 million) amoungst contestants as many fear they have been scammed. SMS entries to the show cost $10.50 AUD. One contestant posted

It shows that nothing has been prepared for this show except the methods for taking our money.

Starwalker returns!

Starwalker returns!

A post on the official Starwalker blog has fired back at claims that the show has been cancelled.

Starwalker is very much alive and well, albeit with massive crew changes behind the scenes. The Dubai financial partner will be assuming direct financial control, and the American filming will concentrate entirely on the resources that the amazing and amazingly talented team led by John Spencer can provide for us.

The post also addressed “dramas” around the fake press release sent out by Jonathan Nolan which pretended to be from Polkadot PR CEO Dionne Taylor and the revelations by the Starwalker: It’s all a bad fraud group that Stephen Hawking is not involved with the show. The original press release claimed that Professor Hawking would have a role in the show and that UK company Red Vision would be co-producing. Two items that have since been proven to be false.

“As for the dramas to date – well, birth is always painful!”

According to the blog, the show will reveal it’s transport providers for the space flights and the two governments supporting the show by years end.

This should be interesting.
