On June the 11th at about 5:45 p.m. I was heading north on Jackson street driving my 1996 Suzuki LS650 (Savage) motorcycle, heading to the
Wal-Mart store to retrieve a prescription for my daughter .As I approached the golf course I was cautious because I had had people try to turn left in front of me before. I approached the gate I saw the southbound red S-10 pickup driven by Jack Honeycutt the 3rd starting to turn left into the gate entering the golf course. I knew there wasn’t enough room for him to cross in front of myself so I applied both the front and rear brakes in hopes to stop before he hit me. I also tried steering my vehicle to the right in hopes of avoiding the front of his truck but the rear tire had locked up and I had almost no steering. He struck the front left bumper corner of his truck with the left midsection of my motorcycle. I heard the crunch and I felt the truck come into contact with my motorcycle .I then felt myself being ejected off the bike and felt my crotch/groin area hit the lower left side of the fuel tank.
I then can only recall standing on the road asking him if he had any insurance ,wondering how I got my helmet off so quickly and feeling lucky as to be standing on my feet. I felt the need to move the vehicles out of the roadway because they were blocking lanes of traffic. We then walked up to the golf course and had a lady call the cops. While walking to the golf course Mr. Honeycutt handed me a piece of paper and asked me if this was his insurance card, I checked the date and it seemed to be valid I also noticed it was from Shelter Ins. I told him that yes it looked like it.
Officer Pruitt arrived and he asked what had happened and he seemed surprised as to the lack of injury to myself. I told him I was not speeding and that I knew the intersection was dangerous. He had me to fill out a voluntary statement. In which I did to the best of my ability considering the pain/shock I was in.
After filling out statements Officer Pruitt asked me if the bike was mobile. I removed the key that had been damaged in the collision, stuck in the remaining key and preceded to start the bike, the engine ran and I put it into gear to see if it would move. It did and Officer Pruitt asked me if I though I could ride it home without any problems. I replied that I would try. I cautiously rode it two blocks back to my house at 508 south Jackson.
At about 8:00 pm I had my brother-in-law drive me to my truck at my place of work, when I arrived home I found Ms. Lou Ann Honeycutt at my home, with a male friend and what I assumed to be a child of hers. She introduced herself as Jack Honeycutt’s mother and proceeded to tell me that she wanted to pay for the damages out of pocket with out filing on his insurance because the premiums would triple. I replied that we would have to see what the dollar amounts were and go from there. She then asked me what the damaged parts of the bike were. I showed her the shock, frame, foot pegs, handlebars, and the fuel tank with the dent into it. She replied that a body shop could fix the fuel tank and I informed her that the paint was unmatchable, and that I would be unable to get a body shop to fix the tank. They left my property at that time.
On Tuesday June 12th I called Mr. Joe Drinnon of Drinnon’s cycle in West Plains Mo. Asking him if he repaired crashed motorcycles and if he gave estimates, he replied that he could do both. I loaded the said motorcycle into my father’s truck and went to his shop in West Plains. After arriving there he informed me that Ms.Honeycutt had already called him asking about the repairs. We unloaded the bike and he got my name, phone number, ect.
After arriving back to Mtn.View I stopped by the Shelter Ins. Office and talked to the lady . She was familiar with Ms. Honeycutt and looked her name up on her computer and said that she (Ms.Honeycutt) had let the coverage run out in December. After leaving there I went by the police station and informed the officers there that Ms.Honeycutt probably didn’t have any insurance, they said that they would check into it. I returned home.
At about 3:45p.m. The same day I received a call from Ms.Honeycutt wanting to know if I had received an estimate for the damages to my bike yet. I replied no I hadn’t and that I would give her a copy when I did. I then informed her that her Shelter INS, had ran out and asked if she had any other insurance at the time. She replied asking me if I was going to let her pay for the damages on her own without filing with her insurance. I told her that I was just protecting my self and that we would have to see what the damages were on the bike. She then told me that she had insurance from Owens Insurance in Mtn. View Mo. (********). She also said that she had told my wife and father-in-law who were there that she had told them that Owens was her insurance agency. Upon asking my wife and father-in-law they both declined hearing her tell them that Owens was her insurance company.
At about 4:30 the same day I met Officer Pruitt on the road in his car and he informed me that she wanted him to give me a ticked for speeding, he informed her that I was not speeding, and he could tell by the damages on the bike and my lack of falling on the ground that I was NOT speeding. He then told me that later that same day she had came into the office to tell Officer Pruitt that she had one of his officers step the skid mark off and that by just stepping it off with his feet he could tell that I had been going at least 45mph.There was no mention of getting the bikes weight or my weight, he just walked it off with his feet. He then informed her that he could cite her son for failure to yield-right-of-way. Officer told me that she said “OH” and walked out of the office.
I received my estimated for the damages on Thursday June 14th. I immediately called Ms.Honeycutt .I asked her if she wanted me to tell her the estimate over the phone or fax a copy of it to her. She said let me get the fax number to city hall and she would call me back. She called me back within a few minutes and gave me the number. I faxed a copy of the estimate to the number she provided.
Ms.Honeycutt phoned me back at about 5:15 June 14th and told me she wanted to make me an offer of $1800. I told her that wasn’t enough to get the bike repaid properly. She then informed me that she had been doing some calling around to her lawyer and to a couple of banks and that $1800. was all the bike was worth. I rejected the offer and told her that the N.A.D.A. value of the bike was between $2265. and $2470. She disagreed and told me to call her lawyer. I asked for his name and phone number and told her we would have to come to some other agreement. I then told her goodbye and ended the conversation. But not before she informed me that she didn’t have any insurance and that the card in the truck was no good.
The next day on Friday morning I went to Owens insurance company to see if she had insurance there like she had told me on the phone the 12th. I gave the estimate and police report to Wanda at the desk. She got out Ms.Honeycutt’s file and made a small”oh my” to herself. I asked her what was wrong and she told me that the wreck had happened on the 11th and she had bought insurance on the 12th. She also told me that she hadn’t mentioned her son jack being involved in a accident the 11th.or that she wanted him to be covered by the same policy. I then called my insurance company to tell them what was going on and asked about my overages. My agent Marcy Collins (417-******) said that she received a phone call earlier from a lady saying she was Owens Ins. And asked if I had insurance there. She said that she would look it up and asked for her phone number. The lady on the phone then said she was Ms.Honeycutt and her son had been involved in an accident with myself. Ms.Collins said she could not give out that information with out a valid claim.
