I'm want to firebomb my real estate agent.
i broke a lease in december. all above board, they advertised the place on their boards with my phone number, a new tennant was found, all was good. they released the bond, im happy, so happy infact i still rent with them for a different property.
then the fuckers call up two months later claiming i have to pay a leasing and letting fee and outstanding advertising costs. they threatern to black list me. now, im no genious, but i seems someone forgot to charge me these fees. how the fuck should i know i have to pay em, i was never given an invoice with these figures on them. so naturally i say no, in a polite manner, referring to every piece of legislation under the sun as to why i am under no obligation to pay it. the office of fair trading agrees. the local legal centre agrees. fuck, even OTHER REAL ESTATE AGENTS agree. now they fucking call today and say they wont back down and want to go to the tribunal to duke it out. fucking bastards. what right do they have to punish me cause some fuckstain office clerk lost the reciept? so i'll go to the tribunal, im sure they'll agree when i show them how stupid this agent has been, but in the meantime i have to sweat all this shit.
there's a certain real estate agent on king street in newtown, around number 212 that you all should avoid like the plague, cause they suck fucking balls.

Think of it this way it costs you nothing to go to the tribunal (presuming you get teh time off work and don't work for yourself) yet it ties up their time and resources (so it costs them money) so what you should do is to write to them prior to the tribunal hearing setting out your version of events and asking where they disagree with how things went down and where they do disagree to provide you with documentary evidence supporting their position. If you get a response you have more info, If they tell you to get fucked they look bad in front of the tribunal. If they don't reply they look bad again.
Presumably the receipt that was lost is a document they have created...if it is there should be other records to verify the receipt for audit purposes etc if not then it is a receipt created by you and you have those records. My bet is it is theirs if so then ask for copies of their records of account and deposit books etc which they must keep by law if they operate a trust account. This will furhter inconvenience them and result in more info for you or them looking bad in front of the tibunal.
Don't fight hard fight dirty and smart.
Also lodge written complaints with fair trading and the Real Estate Institute which they will have to answer in writing tying up more resources

cool. i've also in the past few hours been looking at other descisions made by the tribunal. in all seriousness, they will take one look at this case and decide we owe them nothing. they refunded our bond and then took over 60 days, twice the allowed amount, to try and mitigate their loss. we gave them over 21 days notice we were leaving and the only thing i ever heard of a letting fee was in a letter sent to me after i informed them i was terminating the lease. all well and good, but that letter never mentioned an actual amount, and when i asked them what money was still owing on the place, i was only told of rent to take me up to the day i left, the day after which new tennants moved in.
i dont reckon they have a leg to stand on.

Too easy. You have all your paperwork (don't you?). Threaten them to take it to court and you'll be fine. Talk to the tennants union and they'll set you straight. My 2nd last agent didn't even file my bond the bastard.
Oh - and don't break a lease again okay? Good. Says me with a cat in a no-pets house.

they need to give you notice of the tribunal aplication/hearing ahead of time so before tey do if they do write to them setting out chapter and verse your version with documentary support and asking them to justify in writing their disagreement with your version (if any) if you make it sound lawyerish they will suspect that you are getting assistance on the side and definitely think again.
