OK people will have had worse days, but this day of mine sure did suck, and it has some interesting twists. Read on!

So, I had an exam for uni today, ENGL1001 Arthurian Literature, at 2pm. No sweat. However our phone has been busted for more than a week and the net down for just under a week, so I had no way of studying. Admittedly I hadn't attended a few of the lectures so I also had no idea what was going down.

So I spend Tuesday reviewing cliffsnotes (they rock) and I figure, swoit, I'm in business. Wake up this morning feeling total cactus! Mega bad migraine, slight dizziness and some weird perceptual phenomenae. Nice of the police to point out this last symptom to me.

I was driving at what felt like at or slightly above the 50 kph speedlimit, so I thought at most 55-60. Suddenly flashing lights in my face and police cops. They claim I was doing 78! I'm all, I beleive you since I wouldn't think the cops would just make shit up, but I checked the screen, bingo 78. So I'm all craaaaaaaap. So $208 later and me feelign weird going, "Hrrmm, since my perception is obviously screwed up, I better get to the doctor later"

So I head to my house at Prospect, intending to just relax a bit and head to the doctor later, or if I felt better catch the bus to uni to actually do my exam. Anyways on the way, right near my house, I'm turning right off of the highway and I have right of way, and those on the street I'm turning into have to give way. He fails to see me and T-Bones me right in the drivers side rear quarter!

He gets out, all panicky says he's really sorry and admits fault (mental note: get him to actually sign a statement, maybe tomorrow) and says get a quote and let him know.

But the catch is, he doesn't have any insurance, which I'm not sure if that means "None at all" or just not comprehensive, in which case his 3rd party will sort it out. For the record, I have 3rd party for just this reason, an hefty excess is a lot cheaper than the $2k ish it'll probably cost for the panel beating, respray and chassis straightening!

Anyways, so I'm going to try and make it as easy for the guy as possible, 1) because I don't want to be a dick, and 2) to give him the best possible chance of being able to afford it. Now essentially i'd be happy to have the thing mechanically sound, roughly straight and I don't care what colour it is, as long as it's rust proof. But asking smash repairer to just get $10 K-Mart paint kinda doesn't work. Hell it's how I'D fix it :D. Better than a grand or so to get the spray gun out! Not to mention they'll never match that particular shade of crusty old off white anyway!

One other option is to use Andrews complete vortex which he is palming off to me anyway and putting the guts of my car in that baby, getting the rust fixed up and might work out cheaper and get the victim to pay for that instead. I have some options, but definately, the easier it is on the other guy the better my chances are of getting it done, and him not going "I aint got that dollars"

Also it's rather hard getting a quote without going through insurance, buggers just aren't interested. So you need to find some little guy that will do any job, but they are hard to find, the one I approached was closed for today, said he'd be back tomorrow though.

Seems if you're a big company and can work on 10-15 cars at a time you want nice straight forward insurance jobs cos you just pump 'em through. But if you're the small <5 car place it's the same effort to do a lazy insurance job as a proper private job so they are more willing to take it on.

What makes it worse is I'd only just got the car back on the road after 5 months and I'd put in a new import engine! Also the car was out of rego by a week, so to get me a bit of an alibi I drove it a short distance to get a rego inspection done, which it failed due to a screwed tire, and one of the lights above the number plate. Both mega easy to fix and I'm surprised.

So one of my mates dad is a Smash Repairer, so hopefully he might be able to sort us out with a quote and a decent price.

What a goddamn pants day!

if he only has 3rd party insurance that won't cover squat, only if you had an injury. You should claim whiplash, greek stylee

i think he means third party property damage...

if he doesnt have insurance, your insurance company should fight on your behalf, shouldn't they?

I got a big info pack regarding that with my car... they help you to get your car fixed.

I can't believe how calm and complacent you are with the fact that you're getting screwed over by a guy that doesn't have insurance... and you're worried about YOU sounding like a dick to him!

Let's not even go into the fact that he said he "didnt see you"

I'm presuming he doesn't have 3rd party property if he is claiming that he has no insurance. Ah, what do i know

Meh, I'm usually pretty level headed about crap like this, yeah I'm annoyed, but I don't see the point in going nuts.

Alright, I too only have 3rd Party Property cover for my car, cos I'm worried about doing the exact thing this prong has done, hitting even some other knobs cheap car and having to fork out $2k to fix it. He doesn't HAVE the money he claims, so I said "talk to your parents, or friends or something!" and asked what the deal with insurance is. Turns out it was his girlfriends car, and he thinks she might have third party property, which would solve the problem. He pays the excess on it, I get my car fixed!

I got 3 quotes, one stupid one (obviously the guy just didn't want to do it) at $5000
One from a mates dad who is a smash repairer and $1953, which is very reasonable considering the job he plans on doing, It'd be an extremely good repair.
Lastly, $880 for a "reasonable" fix.

The $2k option is using a 2nd hand panel from another car, the vortex Dumhed is palming off to me :D, and I think $880 is to kinda smoosh the existing panel somewhat straight.

So my plan is, if he can get the cash or has some kind of insurance available, $2k job it is. If not, I'll see if he can sure up $900

Well turns out if I need to I'm covered for $3k on my Third Party for "Uninsured Motorist Damage", but that's a lot of screwing about to get it sorted. Since my car aint worth a whole lot they can opt to just pay it out, you know usual deal. But they subtract from the $3k (assuming the damage is more than $3k on their quotes, the mates rate quote wouldn't work there, also that guy isn't NRMA aproved) the value of the "wreck" and whatever is left to pay on my policy. Since it's in the first month of a new policy year it'd be the whole amount, and it also ends my policy in the process. So i might get $1500-2k, plus a mostly working car, which would work out, I could get it fixed and then have to get a new policy out.

Or if it's less than $3k they just pay it and everything stays the same, but they'll send packs of rabid wolves after the other guy! I sure wouldn't wanna be him in this case.

So instead, cos I want less bullshit, and just want the fucking situation solved, I offered him the $880 quote, and he was much happier said he thinks he can manage that. So I said, yeah gimme dollars, and if you can't do that, well then I gotta get insureance, and that's gonna hurt you bad!

Man, I'm too nice a guy, I should just set the insurance company onto him. Just I'd be so fucking pissed if it happened to me in the reverse. But THAT'S why I have third party.

Oh and get this, would you believe, in the insurance policy, no where does it say your car has to be registered! Only it has to be 'safe' :D
