FORT HOOD, Texas — Defense lawyers sought leniency for Pfc. Lynndie England at a hearing Tuesday to determine her punishment in the Abu Ghraib prison abuse scandal, with a psychologist testifying that the reservist was oxygen-deprived at birth, speech impaired and had trouble learning to read.
West Virginia school psychologist Dr. Thomas Denne the first defense witness said England's learning disabilities were identified when she was a kindergartner and though she made progress in school, she continued needing special help.
A military jury of five men and one woman was seated earlier Tuesday to make a sentencing recommendation for England, 22, who pleaded guilty Monday to seven counts of mistreating prisoners.
England accepted responsibility for the smiling, thumbs-up poses she struck for photographs taken at Abu Ghraib that made her the face of the prisoner abuse scandal.
The charges carry up to 11 years in prison. Prosecutors and the defense reached an agreement that caps the sentence at a lesser punishment; the length was not released. She will get the lesser of the military jury's sentence or the term agreed on in the plea bargain.

Was more of a general statement than anything. This kind of thing is just annoying.
Maybe the next time I get a speeding fine I can blame it on possible oxygen deprivation for a moment when I was born, causing a temporary lapse of concentration when driving past the speed camera? ;)

I won't even get into whether I think the fuss they're making over all this is justified or not... I'm just saying that it's rediculous to find some thing and blame her actions on it like this

Did she know right from wrong should be the only question. I was oxygen deprived at birth too... 13 minutes with my umbilical cord wrapped around my neck... doesn't mean I don't have the capacity to differentiate between right and wrong.

I was about to post about how I thought that associating yourself with the "abuse" that allegedly occured means you should be punished too... but then I thought wait a second.... you're right
She's just in the photo doing a thumbs up... So while she obviously didnt mind that they were stripped them down naked and having them stand there, i doubt that requires a prison sentence of (30 months? cant remember)

All he did was slit his daughters throat, but she deserved it cause she didn't want to marry the man that her father had spent so much time selecting for her.

She's clearly trying to use "learning disabilities" and the fact that she was "oxygen deprived" at birth to minimise her sentence.
In a situation like this, where you have photographic evidence, would it be better to fight it into the ground, only to be found guilty and then get the maximum penalty for the charges (ELEVEN YEARS) Or plead guilty on a plea bargain, and then appeal THAT sentence claiming that you missed a few breaths when you were born and THATS THE REASON WHY YOU DID WHAT YOU DID?

Look at the situation she was in... with the media furore over prisoner abuse, she took the option which would give her the most minimal sentence possible.
Whether or not she's 'taking responsibility for her actions' is debatable.
