Are there fines for retailers who sell OEM software without hardware? I'm asking specifically about Australian law.
If I was to report such an offense who would I have to contact?

Hmmm Fmian, not a single reply in two and a half weeks.
Perhaps no ZGeeker has answered because they're all guilty of buying OEM software (without hardware) and they didn't like your intent to dob someone in.
If perhaps you asked, I'm thinking of buying some OEM software without hardware and am feeling apprehensive about it ... am I commiting an offense ? and if the OEM retailer gets raided then can I get hit too (say) via credit card purchase traceability ?.

Hmm, I can't find any reference to reselling in the Copyright Act, it seems to focus only on copying (obviously), even when talking about 'electronic rights management' that seems to include licenses. It's a violation of the license I imagine, so probably liable to getting sued and facing damages, but I'm not certain.

Legally, as long as you buy any hardware with OEM software, then you arent breaking the law. As a worker in a computer store, whenever I sell any OEM software it is always with some hardware, be it a surge protector, a stick of cheap memory ..... anything, as long as it constitutes hardware.
