So i had this little accident a few weeks ago and bumped the car in front of me. The car two cars in front slowed down and then she slowed down and then i couldnt slow down fast enough so i bumped it and didnt do any damage. However, the bitch still managed to find 2000$ worth of shit to claim, how, i do not know.
My parents cant be bothered fighting it (they have all the quotes from different people etc, and theres really no proof:her word against mine etc) but i just wanted to check: am i "allowed" to send her a letter calling her a cunt without having to worry about any legal ramifications?
cause i really hate the bitch right now. that stupid cunt.
And i'm serious, there wasnt even a scratch on the back of her car when i looked after the accident.

Pay an independent assessor to look at it. It'll cost you about $400 at most and it's good enough proof. Also, let her know she'll need several quotes to prove the damage, or suggest you'd be happy to have it fixed by someone you trust. Is it her insurance company or her that's bothering you?

Oh and don't call her a cunt in writing. If she feels threatened you may get in trouble.
like jimma said, and you should at worse case scenario, have to pay her excess on her insurance claim...
calling people a cunt dont really help the matter after the fact!

calling someone a CUNT is not in itself legally problematic ass it will not give rise to a defamation claim as calling someine a cunt is regarded as vulgar invective and not to be considered a statement of fact from which an actionable defamation can arise.
Make sure that you don't fall foul of any sort of stalking law in the jurisdiction where you live.
I reckon newspaper lettering cut out a-la a ransome note would be most effective and satisfying as it lends that occupational therapy element in constructing the message.
Make sure you don't threaten her in your note. Abuse is one thing but threats are completely another.

thing is, she's apparently gone and fixed it already so cant check it.
and its her insurance company thats bothering us...

write to the insurer stating that there was no damage apparent upon post accident inspection and ask them for a precise breakdown of the damage, its nature and location. That done take their answer to a loss adjuster and ask them if it is something consistent with your description of the accident.

Hey Matty, I was in a car accident about a month ago where some poor guy ran up the back of me at about 5km an hour, in a very similar situation, peak hour traffic, wet road and his car locked up rather than braking nicely like my new little car.
The thing is, I would have thought he would have been expecting to have to slow down as it was peak hour traffic that was continuously starting and stopping. It probably isn't you as he apologised for the accident and took total responsibility. Personally I thought it was just a bad day to be driving, with the slick roads. In fact he wouldn't have hit me if it wasn't for the bullbar.
Anyway, perhaps she is not a "cunt" at all. You see I sent my car to the insurance company that then sent me to one of their approved repairers. In my situation, I had absolutely no control over the cost and I have not even seen a repair bill. Of course I was driving a brand new car and although the damage was slight, the insurance company and repairer have decided to have the entire panel replaced.
I would not have been surprised that if it cost $2000 for the work to my car, because even though the dent was tiny and the scratch about 2 cm's long, the place it was in the car would have made it a labor intensive job, or to replace the panel entirely, which they have decided to do ,would not be cheap.
It is quite hard to fraudulently get more money out of a claim. If though you are certain there was no damage done, then you should let your parents know so that their insurance company can fight the claim. I do wonder though, if there was no damage done, why did you give her your details? Even if the car has already been fixed an insurance appraiser would have had to have a look at it first before the work was done.
If you think you have a case then pursue it, but if it is a case of not having realistic expectations for repair costs then swear a lot to get it off your chest and move on to other things.
I wouldn't write the letter, at least not a rude one. It won't help you, except perhaps emotionally.

Yes the above is correct, put simply these people have to cover costs, and in this day and age to handle a car, with all your appropriate insurances plus paying the labour and parts and of course making some profit you will find very few panel jobs cost any less than $2000.
And also remember new cars are made with bumpers that take the damage underneath, someone drove into my civic a few years back and on the surface it looked minimal but again it was worth around $1500 to fix (about 4 years ago) damn lady hit me, on the other hand if she is a cunt, then let her know if it is her attitude and not just the money involved - just dont get caught :)
