Ok guys, since the workchoices legislation has come in my boss has apparently decided, without telling me, that I no longer need to be paid a penalty rate for working on a Saturday.
I am a barista/supervisor and currently earn $16.50 per hour which I think is supposed to be a casual rate. I have check the OoIR and the award sheet there doesn't say anything about it. Can anyone shed some light on this for me?

How many people work for your boss?
If less than 100, you are basically screwed. Attempt to negotiate but more than likely he will tell you to like it or lump it.

So there's really no choice I have but to take it?
Is there any action he could take against me for organising with the other staff to walk out?
Also, is he under any obligation to inform me of changes in my wages, or can he just change them as he likes and have me find out when I get my payslip?

Im sure hed have to at least inform you. Do you have a contract or terms of work that you signed initially when starting to work there?

Nope, nothing like that. Typical of hospitality. I asked a new employee if he is paid casual or full time and he said it had better be full time, since if he's getting that wage casual something is wrong.

Not likely in a casual coffee shop position.
And he doesn't have to inform you.
Good example are the employers who neglected to inform certain permanent staff members of FNQ businesses that couldn't come to work for one day after the cyclone and weren't paid for it as a result.
First warning they had was on the payslip that didn't add up.

one of my casual workers is called peter, i was sipping my coffe one day and kinda slipped into the character of lumberg 'ahh peter... im gonna have to get you to come in on saturday... yeaahh...'
we all laughed... but then i told peter he had to work saturday night. hehe,,

Back on topic, start your own mobile Coffee Van business, drive it to kids sporting events on the weekend, those Parent standing around watching little Johnny I'm sure would kill for a shot of the black stuff early on a Saturday morning.

After speaking to both my boss and the Workchoices helpline, I have ascertained that I am on the State Shop Employees Award.
Under this award there is no provision for hourly loading for casuals on a Saturday, but there is a Saturday payment in place of loading, of $5.90 if the shift is 4 hours or less and $12.00 if the shift is more than 4 hours.
I have also discovered that my base rate of pay should be $16.43 per hour *plus* $1.37 holiday loading per hour, so essentially $17.80 per hour.
If I can get my boss to properly backpay me I am looking at getting $1200 from him, not including the Saturday loading (for which I am willing to forfiet an amount equal to my previous loading before tax).
