Ok so I just got a new house. I haven't moved in yet. One day I go there to inspect it and find that the light at the back of the veranda has been smashed in and twisted and there's cigarette butt's all over the fucking floor as well as an empty cartoon. Now the only way to gain access to this veranda is for the neighbours on the left side of my house to jump over a fence as this area is secluded and can only be accessed using keys by going through the kitchen of the house. I'm 99% sure I know who committed this crime. I want to know what I can do to fuck this person over using the full extent of the law.

My tolling account was overdue (Which the toll company didn't notify me about). They send me 4 toll notices saying I hadn't payed tolls as my account wasn't topped up. Realising this I topped it up Tuesday night and payed of the notices. The notices were damn near 1 month old which seemed weird, but I payed up and settled the account with an extra $60 on top of it.

Tuesday afternoon at 4:40pm I had a message at home from an unknown number, leaving no names, it simply said "Please call 1300 xxx xxx and quote this number" after which they just hung up.

I call the next morning and it was the collections company on behalf of the toll company. I told them I've already payed the toll company. They wanted a receipt number, I gave it to them and again they just go "Thank you, that's all we need" and hung up in my fucking ear. I leave it at that.

Tonight I get home and there's a letter from some lawyers on behalf of the collections company saying "Please pay $39.35 + our fee of $49.50 within 7 days of this letter. If payment is not received to us, further action will be instituted against you for recovery of the debt without further notice. IF such action is taken it will involve you in additional costs and expense". The letter is dated the 28th.

The debt is already payed, directly to the toll company, before I had contact with the debt collectors. The debt collectors didnt say it was over, but due to them hanging up on me I figured they had everything they wanted. This was done on the morning of the 29th.

Am I within my right to call these lawyers directly and tell them to kiss my arse as the debt was payed directly to the toll company before we spoke? Their letter took 2 days to get here, no one at the collections company told me about any additional fee's either, so I'm pretty pissed of with this.

Hi Hivemind that is the ZGeek

I am going to do something no wise citizen should do, and ask you all for your opinions regarding a situation I recently encountered.

I have a landlady (lives next door) who steals from my girlfriend's vegetable garden. She took stuff on three (that we know of) occasions in the first half of 2009. So for that and other reasons, my girlfriend and I have decided to purchase a house and move out.

Last week, I emailed the landlady to give her the required 14 days notice. Because all the emails she'd sent us in the past few weeks (about tradesmen attending etc) had the real estate agent in the CC field, I CC'ed the estate agent.
As part of my email, I mentioned that one reason for the early termination of the lease was her thefts. These were mentioned as the primary justification for terminating was her repeated failure to observe the "access" section of the lease (even after a letter to her in April to request that section of the lease be adhered to).

Because I mentioned the thefts to a third party, she now has sent me a letter threatening a libel suit, even though what I said was true, unless I retract my comments about the thefts.

Would you retract?

I need a dictionary that defines 'dividing strip'. The Road Rules of Victoria leave state that it is defined by a dictionary, and the Interpretations of Legislation Act 1984 doesn't make any mention of references to dictionaries. The High Court tends to use the Macquarie dictionary, so I think that's the best bet, but mine doesn't specifically define 'dividing strip'.

In case anyone's interested, I got a fine for parking in that big empty dirt square under the Kinds Way overpass which is bordered by City Rd, Moray St and the tram tracks. My feeling is that 'dividing strip' refers to a median strip on a dual carriageway rather than what is used as a car park every day of the year. But, thanks to the laziness of the drafters of this particular piece of subordinate legislation, I need a dictionary to back me up, so any help would be much appreciated.

edit: If 'dividing strip' isn't specifically defined, I'll have to work a definition from 'divide' or 'dividing' and 'strip', but that'd be a much harder sell.

I just thought that I'd share this with the community...

Earlier this morning, I received a takedown notice from Atlantic Records Group / Bad Boy Entertainment (the claimant) over the content posted in http://www.zgeek.com/forum/showthread.php?t=82993 (link may not be SFW). While I cannot publish the details of the takedown notice (bloody DMCA), I can divulge that the claimant says that the Intellectual Property of the nude images in question belong to Atlantic Records Group, and that the images have been published on this site without their express permission.

The takedown notice was sent to the NOC at the data centre that hosts the server, myself as the owner of the server, and the ever endearing Pirate. I have been in communication with the NOC (as they are also carrying out an investigation as per due diligence requirements) and stated:

Quote:

 To whom it may concern,

I have reviewed the content in question. It is in my personal belief that the claimant (Atlantic Records Group) does not hold the copyright on said images. The claimant is a record publishing company and generally does not have ownership of photographs taken of or by their clients for personal use. The content in question also clearly refers to a source article stating that the content in question was obtained by someone who had "hacked into my computer", tending to indicate that this material has not been published, nor ever has been published by the claimant.

That aside, I have forwarded a copy of the "Notice of infringement" to the site's owner and have requested a response on how our customer wishes to proceed. I will continue to update this issue with updates as I am aware of them.

Jarrod Spiga
1337 as Hosting

It's my opinion that the takedown notice has been issued in order to "bully" 1337 as Hosting, our data centre providers and ZGeek into taking down images that they technically don't have the rights to, using the DMCA as a guise to do so. Having said that, I'd like to hear other people's "I am not a lawyer" opinions.

Without giving too much away in case someone searches the internet and finds this thread, lets say I work for a company that had something stolen and then we found one on ebay that looks like it and sounds exactly like it. We spoke to the police and they were wishy washy, and said they'd pass it on to the Adelaide branch, but then they suggested we try to look at it to get the serial number. It's interstate making it difficult for us to look at though the boss is prepared to send some guys over. I'm thinking if it is stolen goods then they won't meet prior to the sale and as it's local pickup only, the sale will probably be made in a public place.

I'm prepared to share the true information with some of you (that I know better) in confidence. I don't know if there's anyone who can get me information off the listing or something. I buy and sell on ebay but don't know much more about it.

Has anyone had any experience with this type of thing? Anyone have any suggestions of the best thing to do?

Cheers :)
