Erk, I can’t believe I am doing this again.

As you may or may not know. ZGeek’s legal troubles are still going. Unfortunately I can’t tell you much about this, except that it is in relation to the person who tried to take out a Personal Protection Order against me for a comments made on this site. A PPO works pretty much like a Apprehended Violence Order. We won that case, but the person has decided to appeal the judge’s decision.

So our next court date is on the November the 8th. And to win this one, we need to fly our legal team from Reardon’s from Queensland to Canberra. The cost will be around $500 to $600. So once again I turn to you, my dear readers. Can you donate a few bucks to help us out?

One of the worlds most "prolific arms dealers" who reportedly inspired the Hollywood film "Lord of War" will be escorted by 50 Thai commandos when he is extradited to the US.

The alleged Russian arms dealer, Viktor Bout, who is dubbed the "Merchant of Death" and faces terrorism charges, went from jail to a Bangkok airport today for his extradition to the United States, Thai police said, despite opposition from Moscow.

US authorities have sent a private jet to Don Mueang airport to fly out Bout, said Crime Suppression Division acting chief Supisarn Bhakdinarinath.

Yeah I heard there was a movie being made about this guy. I wonder what happened to it.

This matter has been settled but feel free to have a read through this as some of it is pretty funny. Basically, two idiots started a thread about their conspiracy book called "A Third Truth" and got flamed. Then attempted to sue us for $42.5 million.

Not only where they defeated when Greg Smith couldn't provide any proof that the film was real, yet alone in production. But their reality TV show "Starwalker" was exposed as an alleged scam.

These guys chose the wrong site to mess with as we where able to defend ourselves and also expose these guys and their dodgy methods.

Jonathan Nolan had plans for the world's most ambitious reality show - a global cross-continent space challenge pitting prospective astronauts against each other for the chance to win two tickets into space.

He told media, partners and contestants that he had already secured two seats on Russian Soyuz rockets, had a production partner in Britain and had already obtained from foreign investors the tens of millions of dollars required to get the project off the ground.

An update on the erstwhile Starwalker “reality series”, for anyone who’s interested in that cosmic soap opera with more twists than Battlestar Galactica….

It seems that with the leaves turning Down Under, the Australian media have awoken from their summer slumber and are beginning to look into the show’s executive producer/bad filmmaker/disbarred attorney/crackpot UFOlogist Jonathan Nolan. (How would you like that on your business card?)

Posting on the Starwalker: It’s All a Bad Fraud Facebook page, Robert Brand says that he will be filming a piece for Australian television about his experiences with Nolan. Brand says that he moved his family to take a job with the show only to be let go without being paid. He ran into serious financial difficulties, including nearly having his car repossessed, but has since found a paying job.

For those unfamiliar with this taudry story, here’s the first part of a long recap.
FYI, Mr Nolan is the guy who started the shennanigans that lead to his chum filing a $42.5 million defemation suit against us. So, to say I am happy about this is an understatment. I hate these current affairs shows, but this time they are doing some good. As soon as we find out when and where this is going to happen, I will let you know. It seems the production of Starwalker, the reality show being made by the chaps who attempted to sue us for $42.5 million has gone completely tits up.

The production team has gone completely silent leaving contestants and now it seems, employees in the lurch. One employee Robert Brand who left the show has not been paid for his work and is now dishing the dirt on the show's executive producer Jonathan Nolan and preparing to sue him for his wages.

One thing that really stood out to me is a comment about the guy who was organizing the spaceflights.

The person confirming the 2 bookings was "Dmitri K. Kumetzov". At this time everyone at Starsem that I talked with knew of no such person working for them in France.

This is really odd. You see the mysterious backer who allegedly pulled out of their film because of the comments on ZGeek was named "Dimitri A. Khalezov"... odd huh? Oddly too, when we contacted the film company he was supposedly from, no one had ever heard of him as well.

Anyway, head over to the facebook group for all the goss and the lols. ...

Ladies and Gentlemen, our defamation lawsuit maybe over but our legal troubles are not. Unfortunately we've got a new problem related to that lot and unfortunately I am not allowed to tell you anything about it. Not a word as I am under orders of the LAW.

But what I can tell you is this, I am looking for a barrister or lawyer based in Canberra wouldn't mind coming with me to court next month. They wouldn't need to do any work. The awesome chaps from Reardon's have done all that and their role would be of someone to help me through the process or take charge and kick arse on my behalf. Whatever they choose.

The $42.5 million lawsuit against ZGeek has been settled after our lawyers required the plaintiff to provide proof of the movie deal that was purportedly lost due to comments posted on this site. We have chosen not to pursue the issue of costs as against the plaintiff as we have formed the view that the collection of any costs which may have been properly awarded against him would likely be uneconomical to pursue.

The lawsuit started back in July 2009 after the plaintiff's business partner Jonathan Nolan posted advertisements in our forum encouraging people to buy his conspiracy book "The Third Truth". A book which claims to have proof that the 9/11 and Bali attacks were nuclear; a theory which the plaintiff supported.

Since the plaintiff started the defamation suit he also applied for a trademark of ZGeek's name and threatened us with a further lawsuit for using "his" trademark despite it not being approved by the Australian Trademarks Office. He has agreed in writing not to pursue that application as part of the settlement agreement.

ZGeek would like to thank Dev Menon and all the staff of Clamenz Corporate Lawyers for their time and skill in helping us defend this matter. Dev and his associates at Clamenz have gone above and beyond in helping ZGeek. They have worked for costs and continue to provide us with advice in protecting the future of ZGeek from further legal harassment.

We'd also like to thank Reardon & Associates for their advice and hard work helping us through this and their continuing support. Also a massive shout out to the EFA for helping us with offering legal help on the trademark issue. I'm happy to say that I am now a member of the EFA (supporting only) and will happily use the small influence ZGeek has to help them out in return.

Despite claims by Myrmidon Enterprises that Starwalker is going ahead. Two more of their crew have abandoned the show stating

We are no longer part of the show. We did not know certain things about the Executive Producer (Jonathan Nolan) until now. So we do not want any parts of the show!

and

Mischa and I on behalf of Viper Productions, LLC is no longer part of the Starwalker project. Due to organizational structural changes, we are no longer associated with the show. We wish the best to all of you!

The two, Richard Myles and Misha Perez are best known for their Indy horror movie Mental Scars and were the only members of the show with any actual successful film making experience.

The announcement has created talk of legal action against Myrmidon Enterprises' management Greg Smith and Jonathan Nolan (the same guys who attempted to sue us for $42.5 million) amoungst contestants as many fear they have been scammed. SMS entries to the show cost $10.50 AUD. One contestant posted

It shows that nothing has been prepared for this show except the methods for taking our money.

A post on the official Starwalker blog has fired back at claims that the show has been cancelled.

Starwalker is very much alive and well, albeit with massive crew changes behind the scenes. The Dubai financial partner will be assuming direct financial control, and the American filming will concentrate entirely on the resources that the amazing and amazingly talented team led by John Spencer can provide for us.

The post also addressed "dramas" around the fake press release sent out by Jonathan Nolan which pretended to be from Polkadot PR CEO Dionne Taylor and the revelations by the Starwalker: It's all a bad fraud group that Stephen Hawking is not involved with the show. The original press release claimed that Professor Hawking would have a role in the show and that UK company Red Vision would be co-producing. Two items that have since been proven to be false.

"As for the dramas to date - well, birth is always painful!"

According to the blog, the show will reveal it's transport providers for the space flights and the two governments supporting the show by years end.

The reality space show Starwalker is no more according to an official of the show Robert Brand. The show was being made by Myrmidon Enterprises, the same people who are attempting to sue ZGeek for $42.5 million.

A post on facebook by Robert Brand states "All, I am now unemployed as Starwalker has cancelled! I am now looking for work so please advise. In fact I would be pleased to develop other space based shows and would like to hear from any Australian film maker interested in doing something. I have taken note of the suggestions and I believe that there are distinct ...possibilities. I have kept my end of the bargain with this group!"

Although on the official blog, it states "Change... and not a moment too soon." So who knows what the future holds.

The show has been mired in controversy after people raising questions about the logistics of the show were banned from the Facebook discussion group. Further to this, it was revealed that Jonathan Nolan sent out a fake press release to various blogs under the assumed identity of Dianne Taylor of Polkadot PR (read more). Further to this was claims by Myrmidon Enterprises that Prof Stephen Hawking was involved in the show. A claim that was later proven to be false.

A lot of people have started paying attention to the chaps suing us for $42.5 million after they allegedly had their reputation tarnished here on ZGeek. But apparently things aren't going too bad for them. They've have launched a new $100 million reality TV show called Starwalker. A show that aims to send contestants into space.

But this has lead to a lot of questions. Namely, how is it going to be done? When people questioned this on the official Starwalker forum (a Facebook discussion group) they were met with rudeness, censorship and then the banning.

So these people started their own facebook group and it looks like they've turned up some interesting stuff. Recently they uncovered a press release issued by Myrmidon Enterprises regarding the show was fake. You can read it here and here in it's unedited orginal form. They have since been "officially" changed on their official sites.

It seems the "special people" behind the legal harassment are getting desperate. Last night while I was out, two police cops turned up on my doorstep wanting to serve me with papers. It seems someone has taken an AVO (Apprehended Violence Order) out against me.

I must be doing something right as these people seem to be very desperate to get me. Alas, if they think they are going to silence or intimidate me then they are very, very wrong. It's just going to make me shout louder and louder.

I suspect it is the ex-lawyer who recently threatened us with a new defamation suit. But unlike these people, I am not completely stupid and have not threatened anyone with anything remotely violent or threatening. I'm just not that dumb despite the rumours. So it will be interesting to see what they have said. I fully think that someone is telling naughty fibs and abusing our legal system. Tut, tut. Turns out it's not fibs. But due to a comment posted by a ZGeek user!

I'll post more tonight once I get served. In the meantime, join this facebook group which is having some great success exposing these people. I'm not responsible for the group. Though I suspect certain people think I am and thus the further harassment. But I fully support them and would like to buy them a beer or two. Ok, this is just getting silly now. Today again, in my mailbox is another express posted legal threat from the Myrmidon friends. Again, threatening me with legal action for defamation unless I edit the google cache (impossible) publish an apology in all Australia's major news papers (LOL) and write a real apology. See this post below first.

The letter is posted after the jump, again it is from the same person we have posted about below. The persons identity has been removed for their own sake.

If anyone can donate to the fund, please do. I feel it is time to open a can of whoop-ass on a few people.

Also, we are looking for a barrister for when the trial starts. So if anyone knows any who would like to help fight this case (the first of it's type in Australia) please contact me.

In case you missed it. About a week or so ago we posted a link to a story on OzSoapbox regarding the Reality TV show Starwalker. A show which is being made by Myrmidon Enterprises. The chaps who are suing me for $42.5 million for defamation and for trademark breach (even though they don't own the trademark).

Because we dared question Myrmidon Enterprises' show, they got their friend to threaten us with another defamation suit.

But good news. I've spoke with our lawyers at Clamenz Corporate lawyers who confirmed that we don't have anything to worry about since the posts are five years old and the statute for defamation is 1 year, or 3 years if a judge orders it.

But there is also a something even better.

This proves that Myrmidon Enterprises and the men behind it are harassing us. Using their legal knowledge to harass us via the court system. How do we know? Well there is that whole thing about applying for the trademark on our site name and threatening to sue us for it. But we investigated this person. We know they are a lawyer so why send the threats knowing about the statute? We also know they are a friend of both Greg Smith and Jonathan Nolan. We took the screenshot (pictured) from their facebook profile and surprise, surprise. Look who's on it.
